A wide range of contracts for the procurement of goods and services by public authorities, including contracts within the building and construction sector, must be put out to open tendering before being awarded.

The tendering process must be conducted in accordance with the EU’s public procurement directives or (where less complicated contracts are concerned) in accordance with the Danish Tender Act (tilbudsloven).

The rules are extremely detailed and consequently rather complex.

Complying with the rules, therefore, makes great demands on the financial players, whether acting as contracting entities or tenderers.

At KIRK LARSEN & ASCANIUS, we are experienced in both preparing and completing open tenders, including: 

  • Drawing up tender notices

  • Drawing up tender conditions

  • Defining appropriate award criteria

  • Completing negotiations and drafting contracts

We also have considerable experience in assisting tenderers, both in preparing tenders which will satisfy the award criteria and in the subsequent negotiations with the contracting entity.

We conduct procurement cases before the ordinary courts as well as before the Complaints Board for Public Procurement (Klagenævnet for Udbud).
